Qualifying under the Rules of Origin
To claim the CEPA preference on filled chocolate (HS 18063100), the goods must qualify as UAE-originating. The Product-Specific Rule (Annex 3B) is "CTSH + VA 40% (CEPA Annex 3B Product-Specific Rule; tariff-shift AND value addition both required)": the goods must undergo a change of tariff sub-heading (CTSH) AND add at least 40% regional value content — both conditions, not either/or. Annex 3B sets that rule at heading level, so it was written for this heading rather than for the chapter as a whole, but it still covers every sub-heading beneath it. Filled chocolate in blocks, bars or slabs is on the liberalised side of Chapter 18, and a genuinely UAE-manufactured product qualifies under a sub-heading change plus 40% value addition. Conching, filling and moulding from bulk chocolate mass is substantial work, so the value limb is realistically attainable here — unlike the many food lines where the UAE only repacks. But note the split within the chapter: this prepared-chocolate line is liberalised while bulk 'chocolate and chocolate products' was kept on India's exclusion list, so the exact eight-digit code decides whether the duty is zero or the full rate. IGST is 5%. FSSAI governs the clearance rather than customs: an import licence, consignment-level food-import clearance, and labelling applied at origin. Confirm both the classification and the manufacturing site before quoting, since each can flip the landed cost independently. A valid Certificate of Origin filed through the eCoO 2.0 system must accompany the shipment; without it, customs charges the 30% MFN rate instead of the preference.
Check your own figures in the Rules of Origin (RVC) qualifier. Qualifying is only half of it — the preference is claimed with a Certificate of Origin, issued in the UAE before shipment or retrospectively within 12 months.

- Per CEPA Annex 3B: CTSH + VA 40% (CEPA Annex 3B Product-Specific Rule; tariff-shift AND value addition both required).. RVC% = [(FOB − value of non-originating materials) / FOB] × 100 (FOB basis).
